Take a swimming test in 8th grade and if you pass it, swimming is optional in the 9th and 10th grade. There would still have to be another aptitude test and review in 10th grade to show that you have maintained your proficiency. If the student does not pass the aptitude test, they must take the elective swimming course. There must be a gender-neutral private booth or outdoors booth at all swimming pools and/or a closed booth inside gendered changing rooms. Swimming divided according to gender and non-binary persons may choose which group to go with. It is important to have comprehensive compulsory education about non-binary issues as early as in the middle forms.
